Within the news with the title; ADSL without phone is approaching” published in your newspaper’s edition dated 26 November 2008, there are some issues reflected incomplete and inaccurate. We request that; the expressions included in the mentioned news and which were not mentioned by our General Directorate should be amended by your self in accordance with the truth, provided that our all rights for legal and punitive action and claim should be preserved related to the owners of the article and publication, director in charge and other relevant persons in charge in accordance with Press Law, Turkish Civil Code, Law of obligations and Turkish Criminal Law, in addition to this; without applying to the Court under the 14th article of the press law no.5187 this response and amendment article should be published in the first following edition of your newspaper in the same page and column and with the same point size just as the same as given above and completely.
On the contrary of the news published in the subject newspaper’s edition dated 26 November 2008 ; in no circumstances, there has not been any expression made by Dr. Paul Doany, General Director of Türk Telecom, emphasizing that,” considering customer complaints, phone line obligation shall be removed in ADSL subscription in near future”.
In his statement, Dr. Paul Doany said that ; it is basic for electronic communication infrastructure and within this context infrastructure and lines, composed of cooper or fiber optic cable and other equipment where ADSL service is provided, should be in operation; and electronic communication should be provided continuously ;in other words, line assigned for customers should be provided in operation continuously and the cost for presenting ADSL service should be covered over subject infrastructure and line, moreover for doing this some calculations should be certainly made.
There has not been made any statement by our General Directorate indicating that; ”considering customer complaints, phone line obligation shall be removed in ADSL subscription in near future”.
As a matter of fact, in accordance with the nature of the service, as it shall be provided technically over physical infrastructure consists of Cooper or fiber optic and relevant devices, it is very normal that this service which is provided over a physical infrastructure should have a cost. Thus, in any case, for providing ADSL service aline should be brought to a house. Therefore, presenting this service by establishing an infrastructure shall have a cost to Türk Telekom or Internet Service Provider which enables the service. Naturally, Türk Telekom, Internet Service Provider or other managements shall reflect this cost to their customers.
Therefore, we do not have any work or evaluation towards providing ADSL service without owning a telephone line. Currently, it is not possible to carry out such a work or make an evaluation under applicable legislation .As a matter of fact, legislation of telecommunication sector, as mentioned by our General Director, requires the cost based accounting of services.
Within this context, providing ADSL service, as a matter of course, necessitates existence and operation of a cooper or fiber optic cable; thus the costs sourcing from the infrastructure which provides ADSL service under the customer’s fixed line opportunity should be covered.
